Trump Administration Urges Supreme Court to Rule Swiftly on Tariff Authority

Washington, D.C. — September 4, 2025 — The Trump administration is pressing the U.S. Supreme Court for an expedited ruling on whether the president has the legal authority to impose broad tariffs under federal emergency powers, arguing that “the stakes could not be higher” for the nation’s economy and trade policy.

The urgent request follows a 7-4 ruling by a federal appeals court that deemed most of former President Donald Trump’s tariffs unlawful under the 1977 International Emergency Economic Powers Act (IEEPA). Despite the ruling, the tariffs were allowed to remain in place until the legal battle is fully resolved.

The case stems from sweeping tariffs Trump imposed on a wide range of imported goods during his presidency, measures his administration defended as necessary to safeguard national security and U.S. industries. However, dozens of states and small businesses challenged the tariffs, contending they inflicted severe economic damage and exceeded the president’s legal authority.

In its appeal to the Supreme Court, the Trump administration insists the IEEPA provides the executive branch broad discretion to act in times of economic and national security emergencies. Critics, however, argue that Trump’s interpretation stretches the law beyond its intended scope, giving the president unchecked power over trade policy.

Legal experts say the Court’s decision could set a precedent for future administrations, defining the limits of presidential authority in deploying economic measures under emergency laws.
